Accordingly, we may hold and use information about you as a customer, a patient/client, or in any other capacity, for example, when you visit our websites, complete a form, access our services or speak to us.

3. Information we collect about patients/clients

  • Name, D.O.B, Gender
  • Contact information including Phone number, email address, emergency contact details
  • Demographic information such as postcode, address.
  • Medical information and information about your functional abilities relevant to the service we provide.
  • Notes and reports about your health.
  • Results of investigations such as laboratory tests, x-rays and MRI
  • Your preferences and interests.
  • Details of your GP, consultant, community services in NHS or social service (who cares for you and relevant to the service we provide)
  • Details of the health care professionals who provide you with care/treatment maintain records about your health and any treatment or care you received previously (e.g. NHS trust, GP surgery).
WHAT WE DO WITH THE INFORMATION WE COLLECT

We may collect and use your information to understand your needs and provide you with a better service, and in particular for the following reasons:

  • Assess your ability and need, to enable us identify problems and devise a treatment plan in discussion with you.
  • Internal record keeping.
  • To improve our products and services.
  • We may periodically send promotional email about special offers or other information which we think you may find interesting, using the email address which you have provided.
  • From time to time, we may also use your information to contact you for market research purposes/satisfaction surveys. We may contact you by email, phone or mail.
  • Use the information to customise the website according to your interests.
  • If applicable, dealing with your insurance company;
  • Internal accounting processes
  • We may disclose information about you to any company or other legal entity which forms part of our group so far as reasonably necessary for the purpose as set out in this privacy policy (including companies we do partnership working and associates like speech therapist/Physiotherapist/occupational therapist who provide service with us. We will not share information to third parties who are not providing service to you through us. We will inform you if we need to provide information to NHS or private therapy service to full fill your needs)
  • We may share your details to social workers or other health care professionals involved in the care, or your family/friends identified by you as involved in your care, with your consent. If you do not have capacity to make decision/provide consent, we might receive consent from your approved next of Kin.
  • We may share your details to  another organisation to whom we may transfer our agreement with you, or if we enter into a joint venture with, purchase or are sold to or merged with another business entity
  • We may share your details to our professional advisors (such as our lawyers, accountants and auditors).
  • We may disclose information we collect from our website to Google (as described in the section ‘how we collect the information’). We may also disclose such information to the organisation which hosts our website or perform SEO or advertisements.
  • In addition we may disclose information about you when required to do so by law, in connection with any legal proceedings or prospective legal proceedings, in order to establish/exercise/defund our legal rights (including providing information to others for the purpose of fraud prevention and reducing credit risk)

4. Information we collect from any visitor to the aspire website

  • device information, such as your hardware model, mobile network information, unique device identifiers;

  • any information you submit via the “Contact us/Get in touch” functions (e.g. name, patient postcode, email address, phone number and message); and/or
  • any other personal information that you otherwise send to us.
HOW WE COLLECT YOUR INFORMATION

We collect information when you:

  • visit our website, browse its pages, or when you return; and/or
  • you submit a message to us via the “Contact us/Get in touch” functions.

Some of the information is collected by a third-party website analytics service provider on our behalf and/or may be collected using cookies which are active on our website.

LEGAL GROUNDS AND PURPOSE OF PROCESSING

It is in our legitimate business interests to do so: to monitor and perform analytics in respect of who is visiting our website; to consider and respond to your message or request.

5. Information we collect from independent contractors (including chartered physiotherapists, occupational therapist)

We collect the following information about you:

  • your name;
  • email and/or postal address;
  • gender;
  • date of birth;
  • employment history and experience (both personal and professional);
  • professional qualifications from the Health & Care Professions Council and the Chartered Society of Physiotherapy, or other professional body);
  • references from previous employers;
  • interview notes;
  • next of kin, spouse or other beneficiaries;
  • bank details for payment by us;
  • disciplinary records, performance records, or performance feedback;
  • timesheets; and
  • other personal information that you may supply to us for adding your profile in the website, including photo.
  • You may be involved / pictured in the Video recording of therapy session or Promotional video about the service we provide.
How we collect your information

We collect information when you:

  • make an application to work for us, or attend an interview with us; and/or
  • commence providing professional services to us.
  • Through Photograph/video recording of the treatment session or promotional video/photos about the service we provide.
Legal grounds and purpose of processing

It is in our legitimate business interests to do so: to keep independent contractor records for administration purposes; to assess your continued suitability for a role and planning progression; for promoting the business publicly; to contact you (and other individuals) and to enforce our contractual terms with you and to defend legal claims or otherwise protect our rights as a business.

Compliance with a legal obligation: in order to prevent fraud or money laundering or to comply with any other legal or regulatory requirements, such as to create a record of your services for us.

HOW WE SHARE INFORMATION

In addition to the information we set out in section 3 of the front of this privacy policy, personal information we are holding about you may on the legal grounds set out in this privacy policy be shared with and processed by our service providers.

It is in our legitimate business interests to do so: to keep internal records for administration purposes; to communicate with you (including with regard to services and fees; to enable our support team to help you with any enquiries or questions in the most efficient way possible; to enforce our contractual terms with you, to defend legal claims or otherwise protect our rights as a business; or to obtain evidence of identity and credit history.

Compliance with a legal obligation: in order to prevent fraud or money laundering or to comply with any other legal or regulatory requirements, such as to create a record of your transaction with us.

7. TELEPHONE CALLS

In the interests of training and continually improving our services, calls to Aspire Rehab limited and its agents may be monitored or recorded. Private calls to and from patients are not recorded.

8. EMAIL ENQUIRIES

Any email sent to us, including attachments may be monitored and blocked if the email you send to us is potentially a threat to our information system. We do not encourage emailing us the personal or confidential information, instead you can attach a password protected document or through post.

9. HEALTH INFORMATION COLLECTED DURING TREATMENTS & SERVICES

Where sensitive clinical information is collected it will be kept confidential and secure, and will only be disclosed to those individuals involved with your treatment or care, or to their agents and, if applicable, to any person or organisation who may be responsible for meeting your treatment expenses or their agents. Information may be provided to external service providers and regulatory bodies for the purpose of clinical audit to ensure the highest standards of care and record keeping are maintained. We will not disclose/sell your information to private agencies for our financial benefit. We will receive your consent (verbal, written etc) if we need to disclose information to the GP, hospitals, social service for the benefit of your treatment/care.

Anonymous or aggregated data may be used by Aspire Rehab limited, or disclosed to others contracted by Aspire Rehab limited, for clinical audit, research or statistical purposes.

10. SECURITY OF YOUR INFORMATION

Aspire Rehab Limited is registered with the Information Commissioners Office (ICO).

We endeavour to protect all information we hold about you by ensuring that we have appropriate security measures in place to prevent unauthorized access, information being lost, destroyed or damaged. We conduct audits to monitor our compliance to Information Security and data protection.

In the usual course of our business, we may use third party organizations to support the essential delivery of our services. This may be to support IT systems in which your information is stored, or for the purposes of data collection, transportation and storage of information and confidential destruction.

Where a third party data processor is used, we ensure that they operate under contractual restrictions with regard to confidentiality and security, in addition to their obligations under the Data Protection Act.

Personal information you provide to us may be held on a secure server in locked information centres and is encrypted wherever possible. Information is kept for as long as is reasonably necessary. Some IT service providers may host data in servers located outside of the EEA using cloud solutions. Where this is the case we have implemented appropriate security to protect the personal information you disclose to us from loss, misuse, unauthorised access, disclosure alteration and destruction. 11. How do we maintain the confidentiality of your records?

We are committed to protecting your privacy and will only use information collected lawfully in accordance with:

  • General Data Protection Regulation (GDPR) 2018
  • Human Rights Act 1998
  • Common Law Duty of Confidentiality
  • Health and Social Care Act 2012
  • NHS Codes of Confidentiality and Information Security

12. Accessing your records

Every member of staff who works for our organisation has a legal obligation to keep information about you confidential.  Individual staff may only view your records with a legitimate reason for a legitimate purpose.  This would of course include the clinician(s) directly involved in your care or other staff who might be ordering or receiving diagnostic results linked to your care.

Other administration or management staff may need to access and use your records to contact you regarding appointments or your care.  Accessing or allowing someone else to access, your record without a legitimate purpose by a staff is a serious data breach and is dealt with under our disciplinary procedures.

We will only ever use or pass on information about you if others involved in your care have a genuine need for it. We will not disclose your information to any 3rd party without your explicit consent unless there are exceptional circumstances (i.e. life or death situations), where the law requires information to be passed on and / or in accordance with the new information sharing principle following Dame Fiona Caldicott’s information sharing review (Information to share or not to share) where “The duty to share information can be as important as the duty to protect patient confidentiality.” This means that health and social care professionals should have the confidence to share information in the best interests of their patients within the framework set out by the Caldicott principles. They should be supported by the policies of their employers, regulators and professional bodies.

13. Verifying your identity

We are required to verify your identity each time you contact us.  You will be asked to provide identity information (for example full name, address, date of birth and NHS number) so your records can be located.

If you wish a spouse, relative or carer to communicate with us on your behalf we will need to obtain your explicit consent before doing so.

14. Where we use your personal data

Personal data of clients and staff are stored securely within the United Kingdom in databases or encrypted drives with multiple levels of security.  This ensures that only authorised Aspire Rehab staff access your record.

Our Patient Administration Systems are not accessible outside of the United Kingdom.  We do not send your data outside the United Kingdom.

15. Your right to have your records changed

You have a right to have inaccurate personal data rectified or completed if it is incomplete.  Clinical notes and clinical opinions will not generally be altered but may of course be supplemented by additional personal data.

16. Our partner organisations:

We may also have to share your information, subject to strict agreements and your consent on how it will be used, with the following organisations:

  • NHS Trusts / Foundation Trusts – if they are involved in your care.
  • GPs
  • Our company associates and partner organisations
  • Therapy associates (self employed staff who provide treatment for you)
  • Organisations who refer to us or we may refer on with your consent e.g. Voluntary sector, equipment supplier.
  • Other ‘data processors’ which you will be informed of – You will be informed who your data will be shared with and you will be  asked for explicit consent for this  when this is required.  In all circumstances we will transit your personal data securely.
17. How we will communicate with you

If you are happy for your data to be extracted and used for the purposes described in this fair processing notice then you do not need to do anything.

If you do not want your personal data being extracted and leaving the service for any of the purposes described, you need to let us know as soon as possible.

18. YOUR RIGHTS

Right of access to your personal information
You have a right under the General Data Protection Regulation (GDPR) 2018 to request access to obtain copies of what information the service holds about you and to have it amended should it be inaccurate. Your data is provided without cost to you.  In order to request this, you need to do the following:

Your request can be made to the main admin email or contacting through the main phone or in person in the clinic or letter. We are required to respond to you within 30 days

Where we are legally permitted to do so, we may refuse your request and if so, we will explain the reasons to you.

  • The right to rectification. You are entitled to have your information corrected if it is inaccurate or incomplete.
  • The right to erasure. This enables you to request the deletion or removal of certain of the information that we hold about you. However, please note that this will not apply if we are required to retain the information for compliance with a legal obligation.
  • The right to restrict processing. You have rights to request that we stop using your personal information or limit the way in which we use it. When processing is restricted, we can still store your information, but will not use it further.
  • The right to data portability. You have the right to request that we return your personal information in an accessible and transferrable format, or that we send it directly to another company, where technically feasible;
  • The right to lodge a complaint. You have the right to lodge a complaint about the way we handle or process your information with the national data protection authority (ICO – https://ico.org.uk)
  • The right to withdraw consent. If you have given your consent to anything we do with your information (i.e. where we rely on consent as a legal basis for processing your information), you have the right to withdraw that consent at any time.
  • The right to object to processing your information. You have the right to object to certain types of processing where we use it for our legitimate interests or for marketing purposes.
19. Retaining your personal information

Unlike many other types of personal information, under GDPR there is no ‘Right to Erasure’ of records.  Indeed the Health Act requires us to retain your records for a minimum of 7 years after we have finished your care (discharge).  Where your care record is part of your GP record, retention is for a minimum of 20 years or 8 years post death.  We are of course still bound by the strict rules of GDPR on how we store, access and release your patient information.

Change of Details

It is important that you tell the person treating you if any of your details such as your name or address have changed or if any of your details such as date of birth is incorrect in order for this to be amended. You have a responsibility to inform us of any changes so our records are accurate and up to date for you.

20. HOW WE COLLECT INFORMATION:
  • We collect information when you directly provide to us (during our therapy session, emails or other means).
  • Data collected automatically for example some information collected about your visit to website or via cookies. We use software program called Google analytics to analyse the use you and other visitors make of our website. Google analytics generates statics and other information about website use by means of cookies, which are stored on users computers. The information generated relating to our website is used to create reports about the use of website. Google may store this information and use them in certain ways, these ways are set out in Google’s privacy policy which is available at http://www.google.com/privacypolicy.html.
21. HOW WE USE COOKIES
  • A cookie is a small file which asks permission to be placed on your computer’s hard drive. Once you agree, the file is added and the cookie helps analyse web traffic or lets you know when you visit a particular site. Cookies allow web applications to respond to you as an individual. 23. CONTROLLING YOUR PERSONAL INFORMATION

We will not sell, distribute or lease your personal information to third parties unless we have your permission or are required by law. We may use your personal information to send you promotional information about third parties which we think you may find interesting if you tell us that you wish this to happen (Should we remove or keep).

If you contact us for any reason we might capture your name and email address to send you emails about our services or products which we think might be of benefit to you. Aspire Rehab limited thereby agree that, unless prior consent from the client, we will not disclose any confidential information to any third party at any time by adhering with the Data Protection Act 1998. Under the Data Protection Act, you may request details of personal information that Aspire Rehab limited holds about you. If you want to make a request, you should write to the company office address or email. If you have any questions or wish to have any personal information edited or deleted, please e-mail as at contact@aspirerehab.co.uk  or write to us. Any information which is found to be incorrect will be corrected as soon as possible.

You may not transfer any of your rights under this privacy policy to any other person. We may transfer our rights under this privacy policy where we reasonably believe your rights will not be affected.

If any court or competent authority finds that any provision of this privacy policy (or part of any provision) is invalid, illegal or unenforceable, that provision or part-provision will, to the extent required, be deemed to be deleted, and the validity and enforceability of the other provisions of this privacy policy will not be affected.
